1. Intellectual Property
LiftBase (hereinafter "the Service") is published by OCLKA. All elements of the Service (design, source code, exercise database, visual identity, trademarks, logos, texts, images, videos) are protected by intellectual property law.
Any reproduction, representation, modification, publication, adaptation, in whole or in part, of the elements of the Service, by any means whatsoever, without prior written authorization from OCLKA, is prohibited and constitutes infringement punishable under the applicable intellectual property laws.
2. License to Use
OCLKA grants the user a non-exclusive, personal, non-transferable, and revocable license to use the Service, subject to the following conditions:
- The user agrees to use the Service in compliance with these terms and applicable legislation.
- The user shall not copy, extract, redistribute, or reuse all or part of the Service's content for commercial purposes.
- The user shall not use the Service for illegal or harmful purposes.
- The user acknowledges that the Service's content (exercise database, metadata, descriptions) is the exclusive property of OCLKA and may not be exported or reused without authorization.
3. Exercise Database
The LiftBase exercise database, including but not limited to exercise names, descriptions, targeted muscles, equipment, difficulty levels, and execution instructions, constitutes an original work protected by the sui generis right of database producers (Directive 96/9/EC and applicable national laws).
Any extraction or reuse, whether qualitative or quantitative, of the database, whether permanent or temporary, by any means and in any form whatsoever, is prohibited without prior written authorization from OCLKA.
4. Trademarks and Logos
The trademarks, logos, and distinctive signs of OCLKA and LiftBase are protected. Any use, reproduction, or imitation of these trademarks without prior written authorization is prohibited and would engage the liability of the infringer.
5. User Content
The user retains ownership of their personal data and workout entries. OCLKA claims no ownership rights over content generated by the user in the course of their use of the Service.
6. Limitation of Liability
The Service is provided "as is" and "as available." OCLKA does not guarantee that the Service will be error-free, uninterrupted, or suited to all the user's specific needs.
OCLKA shall not be liable for:
- Direct or indirect damages resulting from the use of the Service, including loss of data, loss of revenue, or commercial damages.
- Information related to exercises and training, which is provided for informational purposes only and does not replace the advice of a healthcare professional or a certified sports coach.
- Temporary or permanent unavailability of the Service due to maintenance, updates, or force majeure.
7. Evolution of the Service
OCLKA reserves the right to modify, suspend, or discontinue all or part of the Service at any time, without notice or compensation. OCLKA may also update the content of the exercise database at any time.
8. Hypertext Links
The Service may contain links to third-party websites. OCLKA exercises no control over these sites and disclaims any responsibility for their content, practices, or privacy policies.
9. Governing Law and Jurisdiction
These terms are governed by French law. In the event of a dispute, and after attempting an amicable resolution, the French courts shall have exclusive jurisdiction.
