1. Purpose
These terms and conditions of use (hereinafter "the Terms") govern the access and use of LiftBase (hereinafter "the Service"), published by OCLKA. By using the Service, you accept these Terms without reservation. If you do not accept these conditions, you must not use the Service.
2. Definitions
- The Service: refers to the LiftBase platform, including the website, web application, and all features offered.
- The user: any natural person accessing the Service, whether registered or not.
- The account: the personal space created by the user upon registration.
- The content: all data present on the Service, including the exercise database, descriptions, metadata, and any user-generated content.
3. Access to the Service
3.1 Registration
Access to certain features of the Service requires the creation of an account. The user agrees to provide accurate, complete, and up-to-date information during registration. Account creation is reserved for adults or those with authorization from their legal representative.
3.2 Credentials
The user is responsible for the storage and use of their login credentials. Any activity performed through their account is deemed to have been performed by the user, unless proven otherwise. The user agrees to immediately notify OCLKA of any unauthorized use of their account.
3.3 Availability
OCLKA strives to keep the Service accessible 24/7, but does not guarantee absolute availability. Access may be interrupted for maintenance, updates, or technical reasons beyond OCLKA's control.
4. Use of the Service
4.1 Authorized use
The user agrees to use the Service in compliance with these Terms and applicable legislation. The Service is intended for personal, non-commercial use, unless otherwise agreed by OCLKA.
4.2 Prohibited uses
The user expressly undertakes not to:
- Use the Service for illegal, fraudulent, or harmful purposes.
- Copy, extract, redistribute, or reuse all or part of the Service's content for commercial purposes.
- Attempt to access other users' data or disrupt the operation of the Service.
- Use robots, scrapers, or other automated means to extract the Service's content without authorization.
- Introduce viruses, malware, or any other malicious code into the Service.
- Impersonate another user or entity.
4.3 User-generated content
The user retains ownership of the content they generate through the Service (workouts, routines, custom exercises). The user grants OCLKA a non-exclusive, royalty-free license limited to displaying this content as part of the Service's operation.
The user warrants that the content they generate does not infringe the rights of third parties and complies with applicable legislation.
5. Exercise database
The LiftBase exercise database, including exercise names, descriptions, targeted muscles, equipment, difficulty levels, and execution instructions, constitutes an original work protected by intellectual property law.
The user acknowledges that this database is the exclusive property of OCLKA and may not be exported, copied, or reused without prior written authorization.
6. Liability
6.1 Information provided
Information related to exercises and training provided by the Service is given for informational purposes only and does not replace the advice of a healthcare professional, sports physician, or certified sports coach. The user is solely responsible for their sports practice and any injuries or damages that may result.
6.2 Limitation of liability
OCLKA shall not be liable for:
- Direct or indirect damages resulting from the use of the Service or the inability to access it.
- Errors, inaccuracies, or omissions in the Service's content.
- Consequences of sports practice based on the Service's information.
- Loss of user data, regardless of the cause.
6.3 Force majeure
OCLKA shall not be held liable for failures to fulfill its obligations resulting from a case of force majeure as defined by French case law.
7. Personal data
The processing of the user's personal data is governed by the Service's privacy policy. The user is invited to consult this policy to understand their rights and how their data is processed.
8. Cookies
The use of the Service may involve the placement of cookies on the user's device. The user is informed of the purpose of these cookies upon first connection and may configure their browser to accept or reject them.
9. Intellectual property
All elements of the Service (design, source code, database, visual identity, trademarks, logos, texts, images) are protected by intellectual property law. Any unauthorized reproduction, representation, or exploitation is prohibited and would engage the liability of the infringer.

The Service may contain links to third-party websites. OCLKA exercises no control over these sites and disclaims any responsibility for their content, practices, or privacy policies.
11. Modification of the Terms
OCLKA reserves the right to modify these Terms at any time. Modifications take effect upon publication on the Service. It is the user's responsibility to regularly consult the Terms to stay informed of any changes.
12. Suspension and termination
OCLKA reserves the right to suspend or terminate access to the Service in the event of a breach of these Terms, without notice or compensation. The user may delete their account at any time through their profile settings.
13. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and after attempting an amicable resolution, the French courts shall have exclusive jurisdiction.
